When Courts in New Jersey Decide Not to Retain Alina Habba in Her Position, the DOJ Dismisses the Recently Hired US Attorney

After federal judges in New Jersey refused to prolong Alina Habba’s temporary appointment, the Department of Justice promptly dismissed the recently appointed US attorney in the state on Tuesday. Following the district court’s vote to replace the Trump ally with Desiree Leigh Grace, New Jersey’s first assistant US attorney, Attorney General Pam Bondi made her announcement.

However, politically biased judges disqualified her from her role, and the First Assistant took Alina’s place. As a result, New Jersey’s First Assistant United States Attorney was just dismissed. Rogue judges are not tolerated by this Department of Justice, particularly when they jeopardize the President’s fundamental Article II authority, Bondi wrote on X.

Confusion about who will head the state’s chief federal prosecutor’s office resulted from the abrupt transition. It’s unclear if the district court judges will contest the decision or if Grace’s dismissal is legally binding. Additionally, there is considerable misunderstanding regarding Habba’s appointment expiration date.

The ruling issued by Chief Judge Renée Marie Bumb said that Grace’s appointment would take effect “on July 22, 2025, or ‘upon the expiration of 120 days after appointment by the Attorney General’ of the Interim U.S. Attorney Alina Habba, whichever is later.
